Under the general direction of the Assistant Deputy Director, Legal Affairs Division, the Assistant Chief Counsel oversees day-to-day operations of the Legal Division, including supervising and supporting a team of attorneys, managing their workload, and interacting with and advising the Department and its boards, bureaus and programs in various settings.

Licensing requirement: Incumbent must maintain active membership in the California State Bar and be a member in good standing.
The position is subject to the Department of Consumer Affairs' Conflict of Interest Regulations. The incumbent is required to submit a Statement of Economic Interests (Form 700) within 30 days of assuming office, annually by April 1, and within 30 days of leaving office.
Criminal Offender Record Information (CORI): Title 11, Section 703(d) of the California Code of Regulations requires criminal record checks of all personnel who have access to Criminal Offender Record Information (CORI). Pursuant to this requirement, applicants for this position will be required to submit fingerprints to the Department of Justice and be cleared before hiring. In accordance to DCA's (CORI) procedures, clearance shall be maintained while employed in a CORI-designated position. Additionally, the position routinely works with sensitive and confidential issues and/or materials and is expected to maintain the privacy and confidentiality of documents and topics pertaining to individuals or to sensitive program matters at all times.

Working Conditions
The incumbent works in an office setting in the Legal Affairs Division suite, with artificial light and temperature control.
Hybrid telework is available based on operational needs and is subject to change, with a current minimum two in-office workdays per week. On March 3, 2025, Governor Gavin Newsom issued Executive Order N-22-25, which requires departments to adopt a four day per week default in-office requirement beginning July 1, 2025.

Department Information
The Department of Consumer Affairs (DCA) protects and serves California consumers while ensuring a competent and fair marketplace. DCA educates consumers and protects professionals from unfair competition by unlicensed practitioners.
DCA is a unique and dynamic department consisting of 36 different boards, bureaus, a commission, and a program that license and regulate more than 3.4 million licensees in more than 280 license types including certificates, registrations, and permits. The Legal Division serves as in-house legal counsel to the Department and its boards, bureaus, and programs. Legal Division attorneys regularly attend and provide legal advice at public meetings and hearings. They provide legal analysis and opinions on laws, issues, and proposed legislation relevant to the Department and its constituent agencies, including the regulatory licensing laws of the Business and Professions Code, administrative adjudication, the State rulemaking process, and conflict of interest laws. The Legal Division also provides advice on the Bagley-Keene Open Meetings Act, Public Records Act, Information Practices Act, government contracts, and employer-employee matters, such as employee disciplinary matters. The Legal Division serves as litigation liaison with the Office of the Attorney General.
